In the name of Allah most Gracious most Merciful. On the evening of Monday 25th November 2024, Ms Binti Omar called me. I picked the call and heard an automated prompt that said I was being reverse called. I wondered how. CEC wouldn’t have airtime. I agreed to pay for the call because maybe there was some urgent news. After greeting Ma Omar, she informed me in Kiswahili that they were training returning officers that day and they hadn’t received funds or forms to carry out the election in 2 days time. She said they didn’t have even transport refund for the returning officers. She also told me that the returning officers hadn’t yet found presiding officers and that all the Kwale CECs didn’t know what to do. She promptly hanged up (the call). I had seen her the previous day on Sunday 24th November 2024, during the Kwale CEC conference to educate aspirants about the then upcoming grassroots elections. I recognized her as a former MCA. After the call I mused about what to do with the information Ms Omar had just given me. I thought it was uncharacteristic of someone in her position to do so. The people to call were the ODM National Elections Coordinating Committee (NECC) but not me, an aspirant. The situation didn’t sit well with me. I then communicated the incident to Mr Tairo a member of the NECC through the WhatsApp app and cc’d the same to the ODM Chairperson and two of the ODM Deputy Party Leaders. Please find a screenshot of this, attached herewith. Me Tairo then replied to me and told me that all systems were in place and ready and insinuated that Ms Binti Omar as CEC is aware of that. Prior to making the report, I had wanted to screenshot the call log on my phone to show proof that she called me. But I couldn’t find her number. I called SAFARICOM to give me a copy of calls I received as proof of her call, but they said that they only keep records of CALLED numbers and not RECEIVED numbers. In that case Ms Omari would have my number her her call records, to show that she called me. As a countywide leader of a team participating in the grassroots elections, by the end of election day, I received reports that a large majority, close to 80% of ALL polling stations in Kwale County, were not visited by a Presiding Officer. Our people went to the polling stations and found no one there to officiate the elections. A sad affair, that will cause our Party to loose respect and favour across Kwale County. At the end of the election day, I asked my team to note down all the our team members who had arrived at the polling stations and note down how the elections there went. 1. That Ms Binti Omari dismissed from the position of Kwale CEC and not be hired again by NECC to oversee ODM elections. We still have the ward, Constituency and County grassroots elections. We also have the Party nominations coming up in preperation to the 2027 general elections. She is highly likely to bungle those. 2. Repeating the exercise around Kwale in most of these polling stations will be expensive for the Party and aspirants too. It will also be very unfair for the aspirants too. Remember in Kwale County we have now done these grassroots elections THRICE and TWICE the NEB/NECC has cancelled all the results and postponed them, causing massive massive financial loses to aspirants and causing serious disappointments amongst well-meaning Party Members who have repeatedly respected the NEB/NECCs calls to take part in building the Party. In 2021, the elections were done up to constituency level and only the County level was not done. The NECC then called for fresh elections in April 2024 and postponed them 1 DAY before elections because of the big rains. But there were no disruptive rains in Kwale County. Now in November 2024, the grassroots elections have been largely bungled. With the above context, I pray that all those aspirants who were duly registered and had paid the participation fee of 100/-, be declared as the duly elected Polling Centre Committee members. Where more than 30 duly registered and duly paid aspirants applied for the positions, then the NECC should repeat those elections with presiding officers coming from outside the Coast region and be previously unknown to all the aspirants. 3. Respectfully, I am humbly request that you perform due diligence for the whole of Kwale. County before you give your ruling. In the majority of polling stations were elections were conducted, POs arrived with pre-filled result forms and they refused duly registered and paid aspirants from taking part in the elections. Unfortunately a good number of POs are not ODM members and also a good number of the “aspirants” written in the result forms that have been sent, are NOT ODM members and neither did they pay the aspirant participation fee.
